Once Garren King appeared in SIC Hero Saga, Toei/Bandai probably got the copyright on the design.

That's the problem. They certainly didn't spend that much on the initial figure. So he was making a hefty profit using characters owned by Bandai and Toei.

That maybe so but it's actually not like he's making the figure and selling it for that price it just so happens japanese people pay a lot for customs and Bid that high.
Sure we know they can pursue this case and could maybe win if Toei/Bandai cared enough. However I find it kinda unlikely they would bother.

Depends. If they want to make a statement with these two, they'll pursue it. I doubt the gentlemen can do much to fight it because it's pretty crystal clear.

How exactly do you think they can legally fight it? Copyright infringement is pretty clear in this case. Not only is it clear, but its consistent. They have the website showing pictures of every figure, plus the Yahoo auctions they were sold at.

The best they can hope is they get hit with a small fine and told not to do it again.

The I'm sure they can was at Toei/Bandai winning the case. It's just that I highly doubt it's them who called them out. Of course if they are actively involved I'm sure they can win the case if it bothered them so much.

Publishers generally turn a blind eye to doujinshi unless they notice you start to make money. That's the unwritten rule. If you get to the point that you are reasonably popular enough, then you switch to your own stuff. Doujinshi sold at Comiket are mostly just covering the cost of printing.

For instance, the most famous example that everyone brings up is CLAMP, who actually started out doing Captain Tsubasa and Saint Seiya doujins before moving onto their own stuff when they became popular.
