Actually they need to avoid doing that too. Static was meant to be in part a modern take on the Peter Parker/Spider-Man character. The problem with making Miles into such a character is that it will give the impression all they did was make Peter Parker a different color. Miles needs to be his own unique character otherwise he is just going to be derailed as "Black Spider-Man".

I understand why they kept the title Ultimate Comics Spider-Man, still it would probably have been better if they just let Miles assume a brand new superhero identity. If they had to have Miles as Spider-Man it would have been a better idea (to me anyway) have start his career as Spider-Man in a mini-series then at the end have him give it up so he can start his own legacy.
 
Peter Parker recently died for good in the Ultimate universe(not the main one) and now a new kid will be taking over the role of Spider-Man. He's also black (he's mixed race, half Latino and half African American) and could end up being gay (they never said this was going to happen). It spawned from a sarcastic comment from one of the original stories about the reveal that, since he was Black and Latino, the only way certain types of people in America would hate him more would be if he was gay too.

Some people missed the sarcasm, thought it meant he was actually going to be gay and it spread from there.
