Parents ordered to pay 15 million yen because their son kicked a ball.

Source (In Japanese)

So back in 2004, somewhere in the Ehime Prefecture, a 5th grader was practicing soccer free kicks in a school yard with his friends. On such kick cause the ball to miss the net and sail out into the street, where an 86 year-old on a Bike swerved to avoid the ball, crashed, and broke his leg.

He collasped into full blown Dementia soon after the accident and died 15 months later from pneumonia due to being misfed by a nurse.

The man's Family claimed that the accident (indirectly) caused his death, despite his neurological condition being pre-existing, the accident do nothing to the man apart from a broken leg and the boy having no part in how he ultimately died.

The courts ruled that the Boy (Now 19) could not be held responsible since he was a minor at the time, but that his Parents could. So the man's family sued the boy's parents for 60 Million Yen, and won, thought where only awarded 15 Million.

I guess the courts just do not work any more...

Sure, any death is a tragedy, but doing this sort of stupidity kinda shits on the person who passed away :redface2:

The cynical bastard in me is certain the man's family did not do this for closure. They did it for the money. *Ka-ching*

This sort of bullshit is fairly common in the US, but it's sad to see it happening elsewhere, too.

._. Is the US system taking over elsewhere too? Sure does seem like it in this article,.
Some of the settlements and things that go on in the civil courts of the U.S. is mind boggling. Where I live there was a drunk asshole who walked into a Captain D's and got into a fight with the staff. Anyway, the fight somehow moved outside and the drunk fell down an embankment, breaking his neck in the process. The fall ended up paralyzing him. Well, he sued Captain D's and won even though he was the instigator of the entire conflict. His judgement? 40 million dollars.

I heard about another case where a burglar hurt himself in somebody's home that he had broken into. He sued the family of the home he burglarized and won. There's no justice in that.

If the accident indirectly caused complications then they can't legally sue. That's like suing for the butterfly effect. Plus most things like that are void after 5 years of the incident. Tell them to hold out a year and they can't do a thing.
If he was at school, it's actually the school's responsibility, not the parents' responsibility. Someone has a faulty defense.

well for the love of god who fucking places the net in front of the street? Put the nets away from traffic!

Yea pretty much. If a judge can see the case that week or month or whatever. or what branch if falls under. Im not to big into this kind of thing. I just know here in the US our system is messed up badly. Or i think its unfair on a lot of things.

The people suing are probably suffering a lot right now and they are just lashing out at anyone they can. That said... Anyone that would allow a farce case like this to proceed is a complete jack off.
